Terms of use for Swipe to Work

§ 1 Scope

(1) These General Terms and Conditions (hereinafter "Terms") apply to all contracts between ENLAPA GmbH, Radlkoferstr. 2, 81373 Munich (hereinafter "Provider") and users (hereinafter "User") of the "Swipe to Work" platform (hereinafter "Platform").

(2) Deviating conditions of the User are not recognized unless the Provider expressly agrees to their validity in writing.

(3) The Platform is exclusively aimed at consumers within the meaning of § 13 BGB who have reached the age of 18.

§ 2 Subject Matter and Service Description

(1) The Platform offers Users the following services:

  • Upload and AI-powered analysis of CVs
  • Automated matching with suitable job offers
  • Tinder-like swipe interface for job selection
  • Automated job application submission for selected positions
  • Application status tracking

(2) The automated application submission is carried out by an AI-controlled bot that fills out and submits application forms on employers' career portals.

(3) The Provider does not guarantee the success of applications or the availability of specific job offers.

§ 3 Registration and User Account

(1) Use of the Platform requires registration. Truthful information must be provided during registration.

(2) The User is obligated to keep their access data confidential and protect it from third-party access.

(3) In case of suspected misuse of the user account, the Provider must be informed immediately.

(4) The Provider reserves the right to block or delete user accounts in case of violation of these Terms or abusive use.

§ 4 User Obligations

The User agrees to:

  • Only provide truthful information in their CV and profile
  • Not use the Platform for illegal purposes
  • Not perform automated access (bots, scrapers) on the Platform
  • Not violate the rights of third parties
  • Observe the terms of use of the respective career portals

Important note: By using the automated application service, the User confirms that they wish to apply for the respective positions and are authorized to submit applications. The responsibility for the accuracy of the submitted data lies with the User.

§ 5 Automated Applications

(1) By "swiping right" or confirming an application, the User authorizes the Provider to submit an application on their behalf for the selected position.

(2) The Provider uses an AI-controlled bot to fill out application forms. The data is taken from the User's uploaded CV.

(3) The User may be asked to confirm or supplement certain information before final submission (Human-in-the-Loop).

(4) The Provider documents the application process through screenshots for traceability. These are automatically deleted after 30 days.

(5) The Provider accepts no liability for:

  • Technical errors on employers' career portals
  • Changes to application forms by third parties
  • The unavailability of job offers
  • The rejection of applications by employers
§ 6 Prices and Payment

(1) The use of the basic functions of the Platform is currently free.

(2) The Provider reserves the right to introduce paid premium features. These will be transparently presented before contract conclusion.

(3) For paid services, billing is according to the current price list.

§ 7 Liability

(1) The Provider is fully liable for damages resulting from injury to life, body, or health based on intentional or negligent breach of duty.

(2) For other damages, the Provider is only liable for intent and gross negligence as well as culpable breach of material contractual obligations.

(3) Liability for slight negligence is limited to the typical, foreseeable damage for breach of material contractual obligations.

(4) The Provider is not liable for the availability, accuracy, or completeness of third-party job offers.

§ 8 Data Protection

(1) The Provider processes User personal data in accordance with applicable data protection regulations, in particular the GDPR.

Details on data processing are described in the Privacy Policy beschrieben.

§ 9 Termination and Deletion

(1) The User can delete their user account at any time without giving reasons in the account settings.

(2) The Provider may terminate the user account for good cause, in particular in case of violation of these Terms.

(3) Upon deletion of the user account, all personal data of the User will be deleted in accordance with the Privacy Policy.

§ 10 Changes to Terms

(1) The Provider reserves the right to change these Terms with effect for the future.

(2) The User will be informed of changes by email. The changes are deemed approved if the User does not object within 30 days of receiving the change notification.

(3) In case of objection, the Provider may terminate the contractual relationship with 14 days' notice.

§ 11 Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction for all disputes arising from or in connection with these Terms is Munich, provided the User is a merchant, legal entity under public law, or special fund under public law.

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
